Dear Sirs,
We write to you in reference to the constitution and functioning of the National Level Committee for Reforms in Criminal Laws by the Ministry of Home Affairs, which has been tasked with recommending reforms to the Indian Penal Code, the Code of Criminal Procedure and the Indian Evidence Act. As students of the law, it is extremely disconcerting that such an important process is being conducted during these difficult times, when adequate consultation is next to impossible. Amending the criminal laws will have wide-ranging impacts on the civil liberties enjoyed by every citizen in the country. It is imperative, then, that the constitution and functioning of the Committee reflect our constitutional ideals - which emphasize on equality and diversity - lest the final recommendations carry forward the same flaws present in the existing laws. In this light, we write to you to bring two broad concerns to your notice.
Sirs, our first concern pertains to the lack of diversity and representation in the Committee. We understand that the Committee was constituted by the Ministry of Home Affairs on 04 May, 2020 and that you did not personally select your fellow members. However, it is extremely disheartening and alarming that there is absolutely no representation of marginalised communities in the Committee. The lack of a woman-member is especially appalling as historically, women have been excluded from such processes. This resulted in regressive notions being written into the law, which did not account for the lived realities of women. Over the years, we have endeavoured, as a society, to ensure greater participation of women in discussions over such important issues, and their present exclusion is a seriously retrogressive step. Similarly, members from the scheduled castes and tribes, transgender persons, and those from religious minorities have not been included, though they often face the brunt of the law. According to NCRB data, over 55% of undertrials and over 50% of all convicts across the country are either Muslims, Dalits or tribals, even though these communities account for only 39% of the total population of the country. This shows that these communities face disproportionate incarceration due to laws and systems biased against them. Therefore, their voices must be represented in the process of amendment of these laws, so as to prevent these individuals from being further marginalized by the law. Otherwise, the laws will be amended around their presence, without truly reflecting their lived realities.
In addition to the lack of diversity on these grounds, there is also no geographical or professional diversity. The working of the law is completely different across metropolitan cities, semi-urban towns, and the rural parts of the country. Given that over 60% of our population lives outside cities, it would be greatly beneficial for their voices to be given primacy as well. Trial court lawyers, policy-advisors and organizations working in the field would have a perspective markedly different from an academic one. Criminal trials are quite bottom-heavy, with the trial court being the most important venue of adjudication and perspectives of current trial court lawyers and judges are absolutely necessary to reform the criminal process effectively. Their involvement in the Committee would also be valuable in ensuring geographical and professional diversity.
It has been over 150 years since the Indian Penal Code was enacted and we are still fighting against the prejudices and biases that were written into the law then. It would be a matter of grave injustice, to both our fellow citizens and posterity, if we were to incorporate further inequities into the law. The process of suggesting reforms cannot and should not continue unless the Committee is made more representative and we urge you to postpone the process until this is done.
Sirs, our second concern pertains to the inability of the general population to participate in the process of suggesting reforms. It is quite shocking that the committee has decided to continue with the consultation process, despite being in the midst of a raging pandemic. It is completely impossible during the current situation to hold any sort of appropriate consultative exercise. We understand that the Committee has been tasked with submitting its reforms within six months. This timeline coincides with a time where many people have lost their livelihoods during the pandemic—an estimated 122 Million Indians—and are struggling to make ends meet. As students, we currently do not have access to our university libraries due to the lockdown, and many other important stakeholders will also find it difficult to meaningfully contribute to the consultation. In these circumstances, only the most privileged will be able to engage in this consultation in a meaningful manner. An exercise of this magnitude, which will affect every person in this country, cannot be conducted in such an undemocratic manner. The democratic deficit becomes even greater considering that the terms of reference of your Committee have not yet been made public, despite repeated requests to do so. Given the importance of your mandate, it is crucial that this process is done a transparent and open manner rather than in a hurry. Therefore, we request you to provide all relevant information concerning this consultation and advertise it widely to the public.
We understand that you have attempted to enable participation through online consultations. However, a purely online consultation, with questions only provided in English, completely ignores the reality of the backgrounds of a vast majority of our population. Many places lack access to the internet and more importantly, most of the population is not fluent in the English language—the 2011 census recorded that just over 10% of Indians reported knowing and being able to speak some English. The least that must be done is to make the questions available in all regional state languages. Further, online consultations are bound to unfairly affect the marginalised communities more. Only around 55% of Indians are internet users. Going ahead with the consultation in its present form would mean that the voices of millions of underprivileged persons—migrant labourers, adivasis, rural farmers, destitute persons—will be silenced.
Sirs, very often it is these underprivileged communities who unfairly bear the brunt of the law and who lack the resources to secure effective legal representation. Therefore, it is imperative to listen to their voices before reforming the law. In this light, we request you to postpone this process until a more suitable time when everybody will be able to participate effectively.
We humbly appeal to you and urge you on humanitarian grounds to reconsider your participation in this exercise. A process exclusively conducted by a non-representative committee that undertook its exercise in a mere 6 months would suffer from a crisis of democratic legitimacy. In light of all the above, we students strongly believe that this process should not go forward unless there is adequate representation in the Committee, and until the pandemic has substantially subsided.
